Occasionally, we meet with potential clients in need of legal work who would be better served by spending their limited funds on a small business or marketing advisor to strengthen their business plan, rather than spending their funds on a trademark or patent application or other legal work. Part of providing first-rate legal service is not being afraid to tell clients that they would be better off investing their money elsewhere, or that they would be better served by another law firm. That is why our initial client meetings are focused on how our services fit within and advance the potential client’s business. It is not unusual for us to ask clients how their invention, brand, or e-commerce idea is going to generate profits. We also want to make sure that there is a match with potential clients, and our firm has declined representation a number of times over the years where we believe a client will be better served by another firm. For certain small business startup clients that meet our criteria, we entertain creative billing arrangements based on a reduced fee schedule for a period of time to get the client ready for its first round of funding. In return for the reduced fees, the client agrees to provide us with a percentage of the funding capped at a multiple of the value of the services provided. The fee discount, the percentage, and the multiple are dependent on a variety of factors and are evaluated on a case-by-case basis. This incubator model allows our startup clients to get the legal work needed now to take their business to the next level even though their cash flow has not yet matured.
